Effective Registration Inc., a Canadian corporation, with a registered and records office address at 810 - 1111 Melville Street, Vancouver, BC, V6E 3V6 CANADA, ("Effective Registration"), respects your privacy and is committed to protecting your privacy through our compliance with this policy.

This Privacy Policy applies to the Effective Registration online registration services on which it is placed, including but not limited to http://www.effectiveregistration.com and http://erbium.com including subdomains (collectively, the "Service" or "Services") and details information we collect, use and disclose about our users, including you. This Policy also describes your data protection rights, including the right to access, correct and delete information collected about you. This Policy does not apply to information collected by any third party, including any third party application or content that links to or is accessible from our Service.

What type of User Are You?

The following classification of users interact with Effective Registration:

ORGANIZERS - Organizers are individual users that are employees or associates of customers of Effective Registration using the service to manage forms.
REGISTRANT - Registrants are individuals that use the Service in order provide information to Organizers.
VISITOR - Visitors are individuals that interact with our websites, participate in online demonstrations or webinars, or other online marketing activities.

By clicking "I Agree" or by using the Service, you agree to be bound by this Privacy Policy and the Terms of Use. If using the Service on behalf of an organization, you represent that you are authorized to bind the organization to this Privacy Policy and the Terms of Use and are agreeing on behalf of that organization. Where you are using the Service on behalf of an organization, "you" refers to that organization.

Information Collected by the Service

The Service enables Organizers to collect a variety of information about Registrants, such as name, address, organization, email address, telephone number, social media accounts, credit or debit card numbers and other information, including but not limited to, dietary preferences, interests, opinions, activity or workshop selections, age, gender, education or occupation.

Information that is collected about Organizers:

when an Organizer account is created to enable authenticated use of the Service we collect name, organization, address, telephone numbers, email address, and date of birth.
we collect payment information associated with your account, such as credit card number, name and address;
automatically, when an Organizer interacts with our application using commonly used information gathering technologies such as cookies.
when you contact us for support, to participate in surveys, or voluntarily post in our blogs, any personal information you choose to provide about yourself.
automatically, from interactions with third-party services that are integrated with the application to provide aspects of the Service such as payment processing.

Information that is collected about Registrants:

when a Registrant voluntarily and explicitly provides information required by Organizers in order to register for Events.
when Organizers provide or enter Registrant information into our application through a legitimate business interest or under direction or consent from a Registrant
automatically, when a Registrant interacts with our application using commonly used information gathering technologies such as cookies.
automatically, from interactions with third-party services that are integrated with the application to provide aspects of the Service such as payment processing or hotel reservations.

We may collect anonymous, non identifying information from you, which may be provided to us by a third party, including but not limited to:

metrics and other types of statistical data, which could be derived from use of the Service, for example how and when you interact with the Service, session length and number of times you accessed the Service;
diagnostic information concerning the Service, for example, logs, error reports and events and the type, number, date and page relating to this information; and
information concerning how you access the Service, for example, computer operating system, web browser and type of mobile device.

How Information is Used by Effective Registration

Effective Registration's use of the information collected through the Service is limited to the specific purpose of providing the Service for which Organizers have engaged Effective Registration online registration services. Your information is used in the following manner:

maintaining and analyzing the functioning of the Service, such as backing up data
understanding general use of the Service and drawing trends and predictions based on this information;
performing network communications, such as hosting and displaying data and providing updates;
authenticating users of the Service and personalizing content to those users;
protecting the security and integrity of the Service and its users;
legal or regulatory compliance;
providing technical support and resolving Organizer issues;
informing you of changes to the Service such as outages, suspensions or other material changes; or
contacting you with marketing or promotional content or contests, if you previously consented to such contact.
for payment processing and fraud prevention purposes in connection with fees for use of the Service.

How Information is Used by Organizers

When a Registrant uses the Service to register for an Event organized by an Organizer or respond to an online survey or respond to a request for proposal any and all information provided in the context of that interaction will be transferred to, and under the control of, the Organizer.
Organizers will also have access to information related to how the Registrant interacted with the Service (for example, timestamped audit logs illustrating activities such as when a confirmation email was sent to or read by the Registrant).
With respect to European Union data protection directives, regulations and laws, Organizers act as 'Data Controllers' related to the information related to Registrants while Effective Registration acts as 'Data Processor'.
Effective Registration cannot and does not take responsibility for the privacy practices of Organizers. The information practices of Organizers are governed by their own privacy policies. We encourage Registrants to review Organizer privacy policies to understand their practices and procedures.

Third Party Services

In order to provide the Services, information may be disclosed to third parties, who may be located in a foreign jurisdiction and subject to foreign laws, for the purposes listed above. The following third parties may store, collect and use personal information, as well as anonymous information, provided through the Service:

Amazon AWS - database and application hosting services, transactional email service
ZenDesk - related to providing technical support to Organizers
Stripe - related to processing credit card payments
Passkey Inc. - related to securing hotel reservations
Google Analytics - related to tracking aggregate, non-personal information for the purposes of improving the Service

This Privacy Policy only applies to information that Effective Registration collects, uses and discloses and does not apply to the collection, use and disclosure of information by third parties through third party services, which may be broader than set forth in this Privacy Policy. Third party services may be embedded into the Service, such as through an API or SDK, or may take the form of tracking technologies, web beacons and clear gifs. We strongly recommend that you read each third party privacy policy carefully before using the Service. Web Beacons, Cookies and Tracking

The Service uses tracking technologies, such as cookies, web beacons and clear gifs, to collect information about you, for example, demographics, location and device information. Based on this information, Effective Registration may be able to resolve your identity across multiple devices, for example, matching your IP address across multiple devices, in order to target you based on your online behaviour. This information is collected, used and disclosed in accordance with the terms of this Privacy Policy. Certain Service features may rely on 'Strictly Necessary' tracking technologies and by declining to accept cookies or by disabling JavaScript you may not have access to these features. California Do Not Track Disclosure

Do Not Track, or DNT, is a web browser setting that requests that a web application stop tracking of you. When you choose to turn on the DNT setting in your browser, your browser sends a special signal to websites, analytics companies, ad networks, plug in providers and other web services you encounter while browsing to stop tracking your activity. Currently, there is no DNT technology standard and, as a result, the Service does not respond to DNT signals.

California "Shine the Light" Right

If you are a California resident, California Civil Code Section 1798.82 grants you the right to request Effective Registration's disclosure of the categories of personal information we provided to third parties, and the names and addresses of these third parties, for direct marketing purposes during the preceding calendar year. If you are a California resident and would to make this request, please contact Effective Registration using the contact information below. Please note that you may only make this request once per year.

Children

The Service is not directed to children under the age of 13 and we do not knowingly collect personal information directly from children under the age of 13. If we learn that we inadvertently collected personal information from a child under the age of 13, we will delete that information as quickly as possible. If you are a parent or guardian of a child who you believe provided Effective Registration with personal information without your consent, please contact privacy@effectiveregistration.com without delay.

Access, Correction of Deletion of Information

In some jurisdictions, upon request, individuals have the right to access their personal information and have it amended, deleted or restricted. They can also ask for information to be delivered to them, or an organization they nominate, in a machine readable format. We respect these rights and have policies and tools to support their implementation.

If you are an Organizer or Visitor you may contact Effective Registration to obtain a copy of any personal information we have collected about you, the production of which may be subject to a fee as permitted by applicable law. In addition, you may contact Effective Registration to correct or delete such information, except to the extent that retention is necessary for our legitimate business purposes, required by applicable law, in the control of a third party or where correction or deletion is not technically feasible. Please contact Effective Registration using the contact information below.

If you are a Registrant you may contact the Organizer ("Data Controller") of the event to obtain a copy of any personal information collected about you, the production of which may be subject to a fee as permitted by applicable law. In addition, you may also contact the Organizer to correct or delete such information, except to the extent that retention is necessary for their legitimate business purposes, required by applicable law, in the control of a third party or where correction or deletion is not technically feasible. Alternatively, you may contact us at using the contact information below and we will forward your request to the appropriate Data Controller.

Information Storage and Retention

While Effective Registration is a Canadian company, and the data you provide through the Service is stored and processed within Canada, you authorize Effective Registration and third parties acting on Effective Registration's behalf to use and process your data in any country of their choosing, which may cause your data, including personal and anonymous information, to be subject to privacy protections and legal rights that may not be equivalent to those in your country.

Your personal information is retained until you request its deletion as set forth above or until the Organizer no longer requires such information for the purpose for which it was collected. Effective Registration will automatically purge

Information Security

We are committed to ensuring that your information is secure. In order to prevent unauthorized access or disclosure we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you believe that your information is no longer secure, please notify us immediately by contacting us using the contact information below.

Change of Ownership or Business Transition

In the event of, or in preparation for, a change of ownership or control of Effective Registration, or a business transition such as the sale of some or all Effective Registration assets, we may disclose your personal and anonymous information to third parties who will have the right to continue to collect and use such information in the manner set forth in this Privacy Policy.

Email Preferences

We communicate with our users primarily by email. If you would like to change the email preferences we associate with you (for example, unsubscribing from receiving certain types of email) you may do so by clicking a link within emails that we send to you or, if no link is available, by replying with "unsubscribe" in the email title or body.

Updates

Effective Registration reserves the right, in its sole discretion, to modify the Privacy Policy at any time ("Updates") and shall notify you of Updates by email, if you provided an email address, and to make Updates available at http://erbium.com. You are deemed to accept any Update by continuing to use the Service. Unless Effective Registration states otherwise, updates are automatically effective 30 days after posting on http://erbium.com.
